The following policy sets forth how ACT Foundation (“ACT”) collects, uses and discloses the information about ACT’s website users (“Users”) that ACT collects on its website (“User Information”). This policy applies to www.actfoundation.ca, to www.fondationact.ca and any websites related to operation of ACT, including but not limited to ACT Programs, information, rescue reporting, tools, applications, trivia games, and videos. By using or accessing ACT’s website, you are accepting the practices described in this Privacy Policy.

Information Collected

During the nominations and rescue reporting process, ACT collects identifiable information, including, but not limited to, name, company name, telephone numbers, postal and e-mail addresses relating to the User, and any other identifiable information that ACT may reasonably require in order to conduct some of its operations (“User Information”). Users who use the nominations and rescue reporting service may be contacted using the information they provide, all of which are used to identify the Users when they are using such services.

ACT may also collect names, postal or e-mail addresses, and phone numbers of non-User visitors (“E-mail List”), which information would have been provided by a User during the nomination or rescue reporting process.

ACT may also collect information necessary to facilitate sending and tracking electronic mail outs for its Users.

ACT may retain copies of any communications ACT sends to or receives from Users and other visitors to ACT’s site for its records, but will not use any such information except in accordance with the terms hereof.

ACT’s web server collects and saves the default information customarily logged by world-wide-web server software. Specifically, for each http request received, the date and time, the originating IP address, the object requested, and the completion status of the request is collected and saved.

ACT may analyze these logs to determine the traffic through the server in hits, the number of pages served, and the level of demand for pages of interest. ACT may also analyze logs to determine other statistics that may be of value to ACT.

Users upload content on ACT website at their own risk. ACT cannot control the actions of Users and the information that they provide. Therefore, ACT cannot and does not guarantee that User’s content uploaded on ACT’s website will be accurate. Users acknowledge that, even after removal, copies of User’s content may remain viewable in cached and archived pages.

Any improper collection or misuse of information provided on ACT’s website is a violation of the Terms of Service and should be reported to act@actfoundation.ca.

Use of Collected Information

ACT may utilize the information submitted by Users to authenticate and/or verify the identity of such Users and non-Users who may be communicating with ACT. ACT may use the information it collects during the nominations and rescue reporting process, and other information it collects while authenticating the identity of Users and non-Users and the reported information, to operate, maintain and enhance the services offered by ACT. ACT also uses User Information to monitor compliance with the rules and policies.

ACT may compile and analyze its User Information into aggregated research reports. Except as may be otherwise agreed in a separate agreement between ACT and the User, ACT may share this aggregated data with its business partners.

User access, update or deletion of information collected by ACT

Upon written request, ACT will provide to the User a summary of any User Information retained by ACT regarding the User. Users may correct, change or update the User Information and information about their authorized representatives by notifying ACT in writing of such change. ACT undertakes to use its best efforts to correct the User Information within a reasonable time after receipt of such request.

Information Sharing

ACT and its authorized representatives have access to the User Information. ACT shares User Information with third parties when ACT has permission from User, when ACT believes in good faith that the law requires it, or under the circumstances described below.

ACT may disclose User Information when ACT has reason to believe that disclosing User Information is necessary to identify, contact or to bring legal action against someone who may be violating ACT’s Terms of Use or may be causing injury to or interference (either intentionally or unintentionally) with ACT rights or property, other Users, or anyone else who could be harmed by such activities.

ACT may share non-identifiable User Information with any third parties. From time to time, ACT may retain the services of third-party service providers and consultants. ACT may allow these third parties to access User Information.

Disclosure of Personal Information Provided to Forums

If you voluntarily submit or post any information, photographs or other content (“User Content”) to any ACT forums, Twitter pages, Facebook pages or other social networking pages/sites, certain of your personal information may be automatically included in the posting, including without limitation, your user name and email address and this information may be collected and used by others. ACT has no control over and is not liable for the collection, use or disclosure of any posted User Content or your included personal information by users of the Websites, forums, Twitter pages, YouTube, Flickr pages, Facebook pages or other social networking pages/sites. Any personal information posted, used or disclosed via an ACT forum, Twitter page, YouTube page, Flickr page, Facebook page or other social networking page or site is not subject to this Policy. You are responsible for ensuring the protection of any of your personal information that you post on any ACT forum, Twitter page, Facebook page, YouTube page, Flickr page, or other social networking page or site. We recommend that you do not include your home address, job title, telephone number or other more sensitive personal information in any User Content, unless you are entirely satisfied that such information should be made public.

Other Websites

ACT’s Websites may contain links to other websites or Internet resources. When you click on one of those links you are contacting another website or Internet resource that may collect information about you voluntarily or through cookies or other technologies. ACT has no responsibility or liability for or control over those other websites or Internet resources or their collection, use and disclosure of your personal information.

Cookies

ACT’s website may use cookies to recognize each User as an authorized user, and allow ACT to provide customized services and improve the performance and usability of any ACT’s website. ACT may offer certain features that are only available through the use of a “cookie”. User is always free to decline our cookies if its browser permits, although in that case such User may not be able to use certain features on all ACT’s website.

User choices regarding collection, use and distribution of User Information

By becoming a User, each User agrees that ACT may collect certain information (as detailed in this Privacy Policy) from and about the User to authenticate the User and the information the User provides. If a prospective User does not agree to this Privacy Policy, he/she may not become a User.

ACT may offer a User though its website, or through a follow-on email, the opportunity to receive offers and information about products and services from ACT and its partners that ACT believes may be of interest to the User. The User will be provided a choice whether to accept or not accept this offer. If the User accepts, ACT (or agents working on behalf of ACT) may occasionally send the User such information. If this offer is not accepted, then the User will not receive such information.

User Contact

ACT reserves the right, but is not obligated to contact Users regarding information confirmation and/or changes, this Privacy Policy, or any other policies or agreements relevant to a User.

Security Precautions

ACT takes protective measures related to information security to ensure the confidentiality of sensitive User Information while stored or in use within its website.

This Privacy Policy covers exchanges of information within ACT website and through User mailings. ACT’s website may contain links to other sites but ACT is not responsible for the privacy practices or the content of such sites. ACT encourages Users to be aware when they leave ACT’s website to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by ACT.

Changes to the Privacy Policy

ACT may change this Privacy Policy at any time and will post the changes to the Privacy Policy on its website. Any change to this Privacy Policy will become upon posting on ACT’s website unless otherwise agreed with User in writing. Continued use of ACT’s website following such time will mean that the User accepts such changes, which shall also bind its authorized representatives. If a User does not agree to any such change, it must cease using ACT’s website.
